CONSUMER RIGHTS – WITHDRAWAL – CANCELLATION & RETURN CONDITIONS


GENERAL:

  1. When you place an order electronically via the website you are using, you are considered to have accepted the preliminary information form and the distance sales contract presented to you.

  2. Buyers are subject to the provisions of the Consumer Protection Law No. 6502 and the Distance Contracts Regulation (OG: 27.11.2014/29188) and other applicable laws regarding the sale and delivery of the purchased product.

  3. Shipping costs will be paid by the buyers.

  4. Each purchased product is delivered to the person and/or organization at the address indicated by the buyer, within 30 days, which is the legal period. If the product is not delivered within this period, buyers may terminate the contract.

  5. The purchased product must be delivered in full and in accordance with the specifications specified in the order, along with any necessary documents such as warranty certificates and user manuals.

  6. If it becomes impossible to sell the purchased product, the seller must notify the buyer in writing within 3 days. The total amount must be returned to the buyer within 14 days.


IF THE PURCHASED PRODUCT IS NOT PAID FOR:

  1. If the buyer does not pay for the product or cancels the transaction in the bank records, the seller’s obligation to deliver the product ends.


UNAUTHORIZED USE OF CREDIT CARDS:

  1. If it is determined that the buyer's credit card was used unlawfully by unauthorized persons after the product was delivered, and the price of the sold product is not paid by the relevant bank or financial institution to the seller, the buyer must return the product to the seller within 3 days, with shipping costs borne by the seller.


IF THE PRODUCT CANNOT BE DELIVERED ON TIME DUE TO UNFORESEEABLE CIRCUMSTANCES:

  1. If unforeseen circumstances occur, and the product cannot be delivered on time, the situation will be communicated to the buyer. The buyer may request the cancellation of the order, the replacement of the product with a similar one, or the postponement of the delivery until the obstacle is removed. If the buyer cancels the order; if the payment was made in cash, the payment will be returned to them in cash within 14 days. If the payment was made by credit card, the product price will be refunded to the bank within 14 days; however, it may take 2-3 weeks for the bank to reflect it in the buyer's account.


BUYER’S OBLIGATION TO INSPECT THE PRODUCT:

  1. The buyer will inspect the goods/services subject to the contract before receiving them; they will not accept damaged, broken, torn packaging, etc., and defective goods/services from the cargo company. The delivered goods/services will be considered undamaged and intact. If the right of withdrawal is to be used, the goods/services must not be used. The invoice must be returned with the product.


RIGHT OF WITHDRAWAL:

  1. The buyer may use the right of withdrawal from the contract by rejecting the goods without any legal or criminal liability and without providing any reason, within 14 (fourteen) days from the date of delivery of the purchased product to themselves or the person/organization at the address indicated, by notifying the seller through the contact information below or by creating a return request by clicking here.

WITHDRAWAL PERIOD:

  1. If the purchased item is a service, this 14-day period starts from the date of the contract. The right of withdrawal cannot be exercised for service agreements in which the performance of the service has begun with the consumer's approval before the expiry of the withdrawal period.

  2. Costs arising from the use of the right of withdrawal are borne by the seller.

  3. In order to use the right of withdrawal, a written notification must be sent to the seller within 14 (fourteen) days via registered mail, fax, or email, and the product must not have been used within the framework of the "Products for Which the Right of Withdrawal Cannot Be Used" provisions.


USE OF THE RIGHT OF WITHDRAWAL:

  1. The invoice of the product delivered to the third party or the buyer, (If the invoice of the product to be returned is corporate, it must be sent with the return invoice issued by the institution. Returns of orders issued to corporations cannot be completed without a RETURN INVOICE.)

  2. The return form, the box of the product to be returned, the packaging, and if applicable, all standard accessories must be returned completely and undamaged.


RETURN CONDITIONS:

  1. The seller is obliged to return the total amount and documents that put the buyer in debt to the buyer within 10 days from the receipt of the notice of withdrawal and to receive the goods within 20 days. In case of returns not caused by the seller, the shipping cost is borne by the buyer.

  2. If there is a decrease in the value of the goods due to the buyer’s fault or if the return becomes impossible, the buyer is obliged to compensate the damages of the seller proportionally. However, the buyer is not responsible for changes or deteriorations caused by the proper use of the goods or products within the withdrawal period.

  3. If the promotional campaign limit set by the seller is exceeded due to the use of the right of withdrawal, the discount amount utilized in the campaign will be canceled.


PRODUCTS FOR WHICH THE RIGHT OF WITHDRAWAL CANNOT BE USED:

  1. Products prepared in line with the buyer’s request or explicitly their personal needs and not suitable for return, underwear lower pieces, swimsuits, bikini bottoms, makeup products, single-use products, products that are at risk of deterioration or may expire quickly, products whose packaging is opened by the buyer after delivery and cannot be returned due to health and hygiene reasons, products that are mixed with other products after delivery and cannot be separated due to their nature, products related to periodicals such as newspapers and magazines, services performed instantly in an electronic environment or intangible goods delivered instantly to the consumer, and sound or image recordings, books, digital content, software programs, data recording and data storage devices, computer consumables cannot be returned if their packaging has been opened by the buyer, as required by the Regulation. Additionally, the use of the right of withdrawal for services that have begun to be performed with the consumer’s approval within the withdrawal period is also not possible as required by the Regulation.

  2. Cosmetic and personal care products, underwear products, swimsuits, bikinis, books, copyable software and programs, DVDs, VCDs, CDs, and stationery supplies (toners, cartridges, ribbons, etc.) must have unopened, untested, unbroken, and unused packaging to be returned.


DEFAULT AND LEGAL CONSEQUENCES

  1. If the buyer falls into default when making payments with a credit card, they agree, declare, and undertake that they will pay interest within the framework of the credit card agreement made with the card issuer bank and will be liable to the bank. In this case, the relevant bank may apply legal measures; it may request legal expenses and attorney fees from the buyer, and under all circumstances, if the buyer defaults on their debt, they agree to compensate the seller for damages and losses due to the delayed performance of the debt.
